В 2021 г. в развитие конституционной реформы 2020 г. внесен и рассмотрен в первом чтении законопроект «Об общих принципах организации местного самоуправления в единой системе публичной власти», который должен заменить закон 2003 г. Перспектива прекращения действия закона дает возможность проанализировать историю всех его изменений (реализованных и отклоненных) с точки зрения поведения законодателей.В статье на основе базы данных по 452 законопроектам, в которую вошла информация из Cистемы обеспечения законодательной деятельности, анализируются следующие аспекты законотворчества в сфере местного самоуправления: активность и эффективность инициаторов законопроектов (региональные законодатели, депутаты, Правительство РФ, Президент РФ, сенаторы и Совет Федерации); 2) роль парламентских (фракции, комитеты) и внепарламентских институтов и субститутов (Совет законодателей, Общественная палата РФ, Совет по развитию местного самоуправления при Президенте РФ, общественные организации) на разных стадиях законотворчества, включая нулевые чтения; 3) взаимоотношения между парламентскими фракциями в контексте муниципальной реформы (межфракционные инициативы, инициативы оппозиции, блокирующиеся большинством, типы голосования по принятым законам); 4) законотворческие механизмы / практики в IV–VII созывах Государственной думы. В статье предлагается типология поведения парламентских фракций в ходе голосования по законопроектам.</p></abstract><trans-abstract xml:lang="en"><p>In 2023, it will be 20 years since the law, which became the legal basis for the reform of local self-government, was introduced and adopted. In 2021, as a part of the implementation process of the constitutional reform of 2020, a draft bill «On the general principles of organizing local self-government in a unified system of public authority» was introduced and adopted in the first reading, which should replace the law of 2003. The prospect of terminating the 2003 law makes it possible to analyze the history of all its changes (implemented and rejected) in terms of the behavior of legislators.The article is based on database of 452 draft bills, which is built on the information (texts of bills, explanatory notes, reviews of authorities, tables of amendments, records of plenary meetings, voting results) from the legislative activity support system of the SAS «Lawmaking».
